Making a Will in Kildare

Wills prepared by an experienced Kildare solicitor

A Will lets you decide what happens to your property and other assets when you die.

At D’Arcy & Co, we advise clients in Kildare and beyond on making and updating their Wills. We take the time to understand your circumstances, explain the legal issues that matter, and prepare a Will that reflects your wishes.

Paul D’Arcy has more than 20 years’ experience in probate and estate work and holds a STEP/Law Society Diploma in Trust and Estate Planning.

Why make a Will?

If you die without a Will, your estate will be distributed according to the rules of intestacy. Those rules may not reflect what you would have wanted.Making a Will allows you to decide who should benefit from your estate and who should administer it.

Your Will can also deal with matters such as:

  • who you appoint as your Executors;

  • who should act as a Trustee where a trust is required;

  • who should benefit from your estate;

  • arrangements for children under 18;

  • the appointment of Testamentary Guardians for minor children; and

  • particular wishes you may want to record.

Your circumstances may also affect the advice you need. For example, marriage, separation, divorce, children, property, business interests, agricultural land, overseas assets or previous gifts may all be relevant when making a Will.

Making a Will with D’Arcy & Co

The first step is to tell us about your circumstances and what you want your Will to achieve.

We will explain the relevant legal issues and advise you on the choices available to you. We then prepare the Will for you to consider before it is signed and witnessed in accordance with the legal requirements.

We can also review an existing Will where your circumstances have changed.

What we will need to know

To prepare your Will, we will generally need information about:

  • your personal circumstances;

  • your spouse or partner, if applicable;

  • your children and any particular circumstances affecting them;

  • the people you want to appoint as Executors and Trustees;

  • the people you want to benefit;

  • your house and other property;

  • bank accounts, investments and other assets;

  • pensions and life assurance;

  • jointly owned assets;

  • business or agricultural interests;

  • assets outside Ireland; and

  • any previous Will.

You do not need to work all of this out before contacting us. We will explain what information is relevant to your circumstances.

Wills for couples

Where a couple are both making Wills, we will advise each of you on the arrangements that are appropriate to your circumstances.

Many married couples make Wills at the same time, often with broadly similar provisions. However, each person's Will should reflect their own circumstances and wishes.

Keeping your Will up to date

A Will should not simply be made and then forgotten.

You should consider reviewing your Will if your circumstances change—for example, following marriage, separation, divorce, the birth of a child, a significant change in your assets, or the death of someone named in your Will.

If you already have a Will, we can advise you whether it should be updated.

What does a Will cost?

Our current fee for a straightforward single Will is from €180 + VAT.

Two Wills for a couple are from €200 + VAT.

The fee may be higher where your circumstances require more detailed advice or a more complex Will. We will explain the likely cost before you decide to proceed.

Please visit our Fees page for details of our fees and costs generally.

We don't try to do everything.

Our work is focused on property, Wills and estates. Wills and estate administration are closely connected: the decisions made when a Will is prepared can affect what happens when an estate later has to be administered. Please visit our Probate and Estate Administration page for details of our work and services in that area.

We have been doing this work for more than 20 years.

Our aim is simple: clear advice, careful preparation and a Will that properly reflects your wishes.
